Judge James J. Scullary, 88

PITTSFIELD, Mass. — Retired Judge James J. Scullary, 88, of 36 Morewood Drive died Friday, Aug. 24, 2007, at home, with family and dedicated hospice nurses.

Born in Pittsfield on Oct. 9, 1918, son of Samuel and Sadie Ackley Scullary, he graduated from Pittsfield High School, where he received the Tommy Curtin Medal in scholastics and academics, in 1937. He was also a graduate of Williams College and received his law degree from Boston University in 1949.

An Army Air Forces veteran of World War II, he served from 1942 to 1946 as a navigator with the 13th Air Force. He traveled to Australia, New Guinea the Philippines, Okinawa and Japan.

Mr. Scullary practiced law in Pittsfield and was appointed in 1973 as judge of the trial court, where he served until retiring in 1991.

He was a communicant of Mount Carmel Church and a former president of the Berkshire Bar Association. He also served on many other bar committees.

He was a member of the Berkshire Hills Country Club, where he played in golf tournaments over the years. After his retirement, he enjoyed playing golf and spending winters in Florida. One of his final joys was meeting his great-granddaughter, Malia.

He and his wife, the former Rita D. LaPorte, were married in Fort Myers, Fla., on Nov. 24, 1942.

Besides his wife, he leaves a son, James R. Scullary and his wife, Christine, of Tucson, Ariz.; a daughter, Linda A. Paoli of Delray Beach, Fla.; a brother, S. Rocco Scullary of Pittsfield; two sisters, Connie Sheppard and Rita M. Minafra, both of Pittsfield; two grandchildren, James F. and Suzanne A. Scullary; a great-granddaughter, Malia Grace Scullary, and several nieces and nephews.

A sister, Delia Scullary, is deceased.

FUNERAL NOTICE — A Liturgy of Christian Burial for Judge Scullary will be celebrated Tuesday, Aug. 28, at 10 a.m. at Mount Carmel Church by the Rev. Geoffrey J. Deeker, CSS, pastor. Burial will be in St. Joseph's Cemetery at the convenience of the family.

There will be no public calling hours. In lieu of flowers, memorial donations may be made to Hospice Services of Western Massachusetts, in care of Flynn & Dagnoli-Bencivenga Funeral Home, 5 Elm St., Pittsfield, MA 01201, which is in charge of arrangements.
